Hit-and-Run Suspect Could Face Homicide Charges After Victim Dies

Dolores M. Kopacz, 82, who was hit by Kevin P. Brown in December, has died. The District Attorney is investigating whether the death is connected to injuries from the crash.

The 82-year-old Port Washington woman who was injured in December by a hit-and-run driver has died, and sentencing for the man responsible was subsequently delayed while the District Attorney investigates whether her death was related to the crash.

Dolores M. Kopacz was struck by Kevin P. Brown . Kopacz died on Saturday.

Brown was found guilty of "," in June, and was scheduled to appear in court for his sentencing on Tuesday. Sentencing has been rescheduled for 3:30 p.m. Thursday.

If Kopacz's injuries contributed to her death, District Attorney Adam Gerol said he could change the charges against Brown from "injury" to "homicide" by the intoxicated use of a motor vehicle, according to an Ozaukee Press article.

Kopacz's obituary appears in the GilletteNewsRecord.com, the newspaper for the area in which her daughter resides. The obituary blames the crash for her death.

"Mrs. Kopacz, 82, of Port Washington died Saturday, Aug. 18, 2012, at Campbell County Memorial Hospital in Gillette of extended complications from injuries received in a automobile accident in December 2011," it says.

Brown had been on his way to work in Sheboygan when he struck Dolores Kopacz, according to the criminal complaint. Kopacz was walking on County Highway KK (Moore Road) near North Spring Street and the railroad tracks in the Town of Port Washington. Realizing he had hit a person, Brown pulled his vehicle over but then left the scene in a panic. Family later urged him to turn himself in, and he did.

Brown was arrested about 2 p.m. that day. During the arrest, officers detected a strong odor of alcohol on his breath. A preliminary breath test showed a 0.17 blood alcohol content.

Kopacz sustained head, leg and arm injuries and was transported by ambulance to St. Mary’s Ozaukee Hospital and then transferred to Froedtert Memorial Hospital in Wauwautosa by Flight for Life.

Services for Kopacz will be held at 10:30 a.m. Friday at in Port, the obituary said.

I certainly hope the District Attorney can upgrade the charges. This guy should not be rewarded because it took this long for the injuries to catch up to the victim.

lol... Given you share a last name, I am guessing you are related the defendant. As such I will not take offense to your post. Family defends family, right or wrong, and I understand that. But I will not apologize for calling for this criminal to be held accountable for the actions he committed. It was Kevin Brown that chose to get in a motor vehicle and drive while HIGHLY intoxicated. Then, after he had struck a 82 year old pedestrian, while HIGHLY intoxicated, he compounded his poor decision making by fleeing the scene, leaving his victim laying beside the roadway. Did Kevin Brown, after fleeing the scene, then drive to the police to report it? Did he call for help for the lady he struck? Did he return home to await the authorities? No, Kevin Brown completed his drive to work and punched in. He went on with his day, while his victim went to the hospital. Unless you have been living under a rock, there is no one of drinking age that doesn't know and understand that this is one of the possible outcomes of driving drunk. Kevin Brown chose to do so anyway, with tragic results. I have no problem calling for stiff penalties. He may be a quality person, but that morning, his behavior was criminal, and indefensible, and he should pay a hefty penalty for it. And that includes prison in my opinion.

An update to this article: The District Attorney found that there is no connection between Dolores Kopazc's death and the accident. Kopazc came down with cancer in spring and ultimately died of pneumonia on Saturday. Here is an article about Brown's sentencing: http://patch.com/A-xmxQ

Hey Michael - your are the useless waste of skin that visited Dolores on Christmas Day crying your eyes out that you could not spend the day with your father as he was incarcerated...well did you happen to think of Dolores lying in her hospital bed severly injured on Christmas Day. Her daughter so far away with no one really to visit her. I was there but just a few hours too late to confront you. Sad that you could only think of your daddy in jail not being able to see him and then you even had the nerve to plead with Dolores not to SUE your dad. Really...who is the useless waste of skin as you posted earlier - I think that would be YOU - Michael Brown. I do forgive your father for his poor judgement that day back in December of 2011 but I do feel that he committed a crime and now needs to pay his time.

DN, The Brown children have attacked anyone that comments on this issue and have gone so far as calling people out to "meet" them. I have had a special place in my heart for Dolores, since this tragic incident happened. I meant no disrespect for her or her family. I actually am glad that this is over, it is best for all involved.

First off, I am just shaking in terror. Posting threats like an on-line bully? Really? Still in middle school are we? If this is typical behavior for you, as the derivative result of your fathers genetics I am going to guess that poor decision making was not a new discovery for him. Second, as far as minding my own business, this is the business of us all. Basic sociology dictates that issues of crime and punishment are the legitimate concern of the electorate. Or, for the slower kids in the room, the judge and the prosecutor are both elected officials. As a voter, how they handle crime and the criminals that commit them is how you judge their job performance and decide your vote. So yes, it is our business. Oh, and as a Port Resident, the fact that your dad is driving our streets out of his mind drunk, is a legitimate cause for concern as well. But your opinion is yours, so you are welcome to it. And if you do ever decide to look me up and make good on that threat, so be it. I suspect that our encounter will differ vastly from the picture you drew in your head (likely in crayon).

Well, sort of. He can't prove a connection. Does not mean there is no connection. The District Attorney has to operate on a higher standard of proof than public opinion requires. Beyond a reasonable doubt and guilty until proven innocent are legal standards not necessarily applicable to opinion. Delores was a healthy, seemingly vibrant older women before becoming this mans victim. Less than a year later, she is dying in assisted care that she never left after the accident. I choose to see a connection, and a connection I believe is reasonable.
